19900327 r-90-10RESOLUTION NO. R-90-10 A RESOLUTION TO DENY THE REQUEST OF FAIRFAX MEDICAL ARTS, INC., BY ROBERT C. KERTSCHER, PRESIDENT, FOR A SPECIAL EXCEPTION TO THE TREE PRESERVATION ORDINANCE ON THE PREMISES KNOWN AS 10080 MAIN STREET AND MORE PARTICULARLY DESCRIBED AS TAX MAP 57-4-((3))-50 AND 51. WHEREAS, Fairfax Medical Arts, Inc., has submitted application No. SE-68-90-1 requesting the following Special Exception to the City Code: Section 26-69(a) (1)b: To allow a parking area without the required seven-foot boundary landscaped strip. WHEREAS, City Council has carefully considered the application, the recommendation of the staff and testimony received at the public hearing; and WHEREAS, city Council has determined that the proposed Special Exception is not appropriate for the following reasons: The property is an eye-sore to the community and has been allowed to deteriorate to the point where it is no longer a good neighbor. There is a very serious safety problem getting in and out of the Fairview subdivision at both Fairview Drive and Tedrich Boulevard. The residents do not want the child care center in the neighborhood. It will abandon the residential nature of the property because it will have to reconstruct the facility and tie it into the ingress and egress of an existing commercial property and will never be able to revert back to a residential use if the venture fails. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Fairfax on this 27th day of March, 1990, that application No. SE-68-90-1 be and hereby is DENIED.
