R-90-24 A RESOLUTION TO APPROVE THE REQUEST OF COMPSON DEVELOPMENT LIMITED PARTNERSHIP BY JAMES COMPARATO, GENERAL PARTNER, FOR A SPECIAL EXCEPTION TO THE SIGN ORDINANCE TO ALLOW TENANT IDENTIFICATION SIGNS ON THE BUILDINGS OF A MIXED USE OFFICE PARK ON THE PREMISES KNOWN AS FAIRFAX COMMONS, LOCATED AT 3911-3929 OLD LEE HIGHWAY AND MORE PARTICULARLY DESCRIBED AS TAX MAP 57- 2((37)) . WHEREAS, Compson Development Limited Partnership has submitted application no. SE-73-90-3 requesting Special Exception to the City Code to allow tenant identification signs on the buildings of a mixed use office park. WHEREAS, City Council has determined that the proposed Special Exception is appropriate because the proposed sign use meets the criteria established by Fairfax City Code, Section 26-48(b) (1)&(2) as follows: (1) The applicant has clearly demonstrated that requirements contained in this Division will present a unique burden due to unusual topography, vegetation, building design or lot shape; and (2) The City Council has determined that the granting of Special Exceptions will not be inconsistent with the Comprehensive Plan or the purpose of this Division as stated in Section 26-40. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Fairfax on this 26th day of June , 1990, that application no. SE-73-90-3 be and hereby is APPROVED subject to the following conditions: The previously approved 12-inch individual black plastic letter sign scheme be continued. In lieu of the building identification signs for unoccupied or new buildings, one tenant sign be permitted for each building unit. Building-mounted signs be permitted for retail, personal services and professional services tenants on the ground floor. 4. No ~signs be allowed above sill of the second-story windows.
