R-89-29 A RESOLUTION TO APPROVE THE REQUEST OF JASON SANGWOO KIM, OWNER OF COURTHOUSE MARKET FOR SPECIAL EXCEPTIONS FROM SPECIFIED PROVISIONS OF CHAPTER 26 OF THE CODE OF THE CITY OF FAIRFAX FOR PROPERTY LOCATED AT 4328 CHAIN BRIDGE ROAD AND MORE PARTICULARLY DESCRIBED AS TAX MAP 57-3- ((2))-41. WHEREAS, Jason Sangwoo Kim has submitted application No. SE- 53-89-1 requesting the Special Exceptions to the City Code listed below: Section 26-39.2(e)¢l)a: To permit a landscaped front yard with less width than the required 25 feet along School Street (the narrowest area will be 5.5 feet deep and the widest area will be 17 feet deep). Section 26.39.7(a): To allow a 10% reduction in the number of required parking spaces (from 21 spaces required to 19 spaces) for a mixed use development. WHEREAS, City Council has determined that the proposed Special Exception is appropriate because the proposed development meets the requisites established by Fairfax City Code Section 26-39.7(a)(1) and (c) for the following reasons: 3. 4. 5. Landscaping of the front yard on Chain Bridge Road to replace the existing parking lot; Paving of the gravel parking lot and formalizing the parking arrangement; Enclosing the dumpster with a board-on-board fence: Landscaping the front yard on School Street with appropriate shrubs and trees; and, Provision of a wood fence on the residential property line which will screen the shopping area from the residential neighborhood. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Fairfax on this 27th day of June , 1989, that application No. SE-53-89-1 be and hereby is approved with the following conditions: That the landscaping on Chain Bridge Road and School Street be done in accordance with the Community Appearance Plan. That the board fence on the residential property line be a board-on-board fence. That the building addition be finished in brick or masonry that matches the proposed facade on the existing building. That the storm water management facilities, including detention facilities, if they are needed, be shown on the final site plan for construction. That existing vegetation on the perimeter of the site adjacent to the residential areas be retained where possible and the board fence be located so as not to endanger the retention of trees and other vegetation.
