19880712 r-88-34RESOLUTION NO. R-88-34 A RESOLUTION TO APPROVE THE REQUEST OF E-Z AUTO TOP & UPHOLSTER ¥, INC., B ¥ EDWARD R. SWARTZ, OWNER, FOR SPECIAL EXCEPTION FROM THE SPECIFIED PROVISION OF CHAPTER 26 OF THE CODE OF THE CIT¥ OF FAIRFAX FOR PROPERT¥ LOCATED AT 3775-C PICKETT ROAD AND MORE PARTICULARL¥ DESCRIBED AS TAX MAP 58-1-((2))-3Q. WHEREAS, E-Z Auto Top & Upholstery, Inc., has submitted application No. SE-35-88-1 requesting special exception to the City Code Section 26-39.7(b) to allow parking on a separate lot. WHEREAS, City Council has determined that the proposed special exception, with modification, is appropriate because the proposed development meets the requisites established by the City of Fairfax Code Section 26-39.?(b) for the fol- lowing reasons: The parking area is located on property upon which the right to use such parking is established by ownership, and will be available for so long as the use exists. The parking area is located on property possessing the same zoning district designation as the principal use. e The parking area is located within 500 feet of the principal building en- trance and is accessible by an improved pedestrian aeeessway. 4. The parking area is conveniently usable and will not cause unreasonable: ae Hazard to pedestrian and vehicular traffic; Traffic congestion; or Interference with safe and convenient access to other parking. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Fairfax on this ] 2th day of July ,1988, that application No. SE-35-88-1 be and hereby is APPROVED with the following condition: The parking spaces on the Fairfax Ice Arena lot be available to E-Z Auto Top & Upholstery, Inc. for a term that coincides with the current and any future leases.
