19880802 r-88-38RESOLUTION NO. R-88-38 A RESOLUTION TO APPROVE THE REQUEST OF COMBINED PROPERTIES LTD. PARTNERSHIP B ¥ RONALD HAFT, GENERAL PARTNER, FOR SPECIAL EXCEPTIONS FROM SPECIFIED PROVISIONS OF CHAPTER 26 OF THE CODE OF THE CIT¥ OF FAIRFAX FOR PROPERT¥ LOCATED AT 9444 THROUGH 9542 ARLINGTON BOULEVARD AND MORE PARTICULARL¥ DESCRIBED AS TAX MAP 48-3-((2))-11 AND 48-3-((6))-1, 2, 3, 4, 5, 6, 7, 8, 9, 10, 11, AND 12. WHEREAS, Combined Properties, Ltd. Partnership has submitted application No. SE-40-88-1 requesting the special exceptions to the City Code sections listed below: Section 26-39.2(e)(1) to allow a front landscaped strip 2 feet wide where 25 feet is required; and ® Section 26-39.7(a) to allow a 20 percent reduction in the number of re- quired parking spaces for a shopping center. Section 26-173(c)(1) to allow parking in 23 feet of the required 25-foot front yard. WHEREAS, City Council has determined that the proposed special exceptions are appropriate because the proposed development meets the requisites established by City of Fairfax Code Section 26-39.7(a) for the following reasons: ie The uses in the shopping center are quite varied and do provide the mix of parking demands that will allow spaces to be normally available for each use. Be The reduction in parking spaces will not impair the supply of light or air to adjacent property, unreasonably increase traffic on public streets, en- danger public safety or diminish adjacent property values. WHEREAS, City Council has determined that the proposed special exceptions are appropriate because the proposed development meets the requisites established by City of Fairfax Code Section 26-39.7(c) for the following reasons: ie Will not result in increased traffic congestion or negatively impact exist- ing pedestrian or vehicular traffic flow or safety; B. Will not be contrary to objectives specified in the Comprehensive Plan; C. Will permit a reasonable use of the property; and D. Will not adversely impact adjacent properties. WHEREAS, City Council has determined that the proposed special exceptions are appropriate because the proposed development meets the requisites established by City of Fairfax Code Section 26-173(f)(2) for the following reasons: ie Will not result in development which is disproportionate to surrounding land uses; B. Will not adversely affect any nearby residential areas; Will not overburden existing community facilities or result in obstruction of light and air, endanger traffic, or cause traffic congestion or increase danger from fire, flood or other hazards; and D. Will not be contrary to the objectives of the Comprehensive Plan. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Fairfax on this 2nd day of August ,1988, that application No. SE-40-88-1 be and hereby is APPROVED with the following conditions: R-88-38 -2 m The free-standing signs in the shopping center be brought into conformance with the sign ordinance upon reconstruction of the parking lot. The 25-foot landscaped strip along Arlington Boulevard to be constructed and maintained by the applicant. This strip and sidewalk to be continued off site along Arlington Boulevard for an additional 200 feet to the west. Landscaping to be provided in general conformance with Exhibit A.
