WHEREAS, the City Council of the City of Fairfax, Virginia deems it neces-
sary and essential to and in the best interest of the public health, safety
and welfare to widen Chain Bridge Road (Route 123) within the City of Fairfax,
Virginia; and
WHEREAS, it is necessary for the City of Fairfax to acquire fee simple
title to a portion of a certain parcel of land owned by Stafac, Inc., a
Delaware corporation, hereinafter referred to as the "Stafac, Inc./Chain Bridge
Road Parcel", said necessary portion of the parcel is described on the plat
attached hereto as Exhibit "A" and incorporated by this reference, and
WHEREAS, the bona fide efforts of the City to acquire the aforesaid neces-
sary portion of the Stafac, Inc./Chain Bridge Road Parcel from the owner by
means of purchase have proved unsuccessful, and the City of Fairfax and the
owner cannot agree on the terms of purchase; and
WHEREAS, it appears that it may be necessary for the City to exercise its
)ower of eminent domain in order to acquire fee simple title to the aforesaid
necessary portion of the Stafac, Inc./Chain Bridge Road Parcel.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF FAIRFAX
VIRGINIA: ,
1. The City of Fairfax, Virginia declares that it is necessary to acquire
the fee simple title to a necessary portion of that certain parcel of land in
the City of Fairfax, Virginia owned by Stafac, Inc., a Delaware corporation,
said portion of the parcel is described on the plat attached hereto as Exhibit
"A" and incorporated by this reference, so that the City of Fairfax may widen
Chain Bridge Road.
2. The City of Fairfax, Virginia declares that since the owner of the
parcel and the City of Fairfax have been unable to agree on terms of purchase
it may be necessary for the City of Fairfax to exercise its powers of eminent
domain to acquire the necessary portion of said parcel as designated in the
attached plat.
3. The City of Fairfax, Virginia hereby authorizes the City Attorney to
acquire the necessary portion of the Stafac, Inc./Chain Bridge Road Parcel by
appropriate legal means, including condemnation.
