A RESOLUTION TO APPROVE THE REQUEST OF RAJ K. KAPOOR OF CIRCLE SHELL FOR
SPECIAL EXCEPTIONS FROM SPECIFIED PROVISIONS OF CHAPTER 26 OF THE CODE OF THE
CITY OF FAIRFAX FOR PROPERTY LOCATED AT 9605 LEE HIGHWAY AND MORE PARTICULARLY
DESCRIBED AS TAX MAP 48-3-((8))-1B.
WHEREAS, Raj K. Kapoor has submitted application no. SE-21-87-1 request-
ing the Special Exceptions to the City Code as listed below:
Section 26-176(b) to permit the principal building of an Automobile
Service Station to be located less than 75 feet from the public
right-of-way;
2. Section 26-178(a)(1) to permit a lot area of 18,000 square feet
where 22,000 square feet is required;
Section 26-178(c)(1) and 26-39.2(e)(1) to permit landscaped strips
of 3, 7, 6 and 3 feet where 25 feet is required and to permit a
canopy to be constructed to within 17 feet of the front property
line, where 25 feet is required;
Section 26-178(c)(2) and Section 26-39.2(c)(2) to permit a 3-foot
perimeter landscaped strip where a 12-foot landscaped side yard is
required; and
WHEREAS, City Council has determined that the proposed Special Exception
is appropriate because the proposed development meets the requisites estab-
lished by Fairfax City Code Section 26-39.7(c) and Section 26-178(f)(2) for the
following reasons:
Section 26-39.7(c):..
1. Will not result in increased traffic condition or otherwise nec
impact existing traffic flow or pedestrian or vehicular safety; and
2. Will not be contrary to the objectives specified in the Comprehensive
Plan;
3. Will permit the reasonable use of the subject property; and
4. Will not adversely impact adjacent property or the surrounding area.
Section 26-178(f)(2):
1. Will not result in development which is disproportionate to surround-
ing land uses; and
2. Will not adversely affect adjacent residential areas; and
3. Will not overburden the existing community facilities; and
4. Will not be contrary to the objectives of the Comprehensive Plan.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Fairfax
on this 23rd day of June, 1987, that application No. SE-21-87-1 be and hereby
is approved.
