WHEREAS, the area in the vicinity of the intersection of North Street, Truro
Lane and West Street and the intersection of West Street and Main Street is a part of
the Old and Historic District of the City of Fairfax and includes buildings and
structures having important historic, architectural and cultural interest, such as the Old
County Courthouse and 3ail, the National Bank of Fairfax Building, the McCandlish
House, the Van Dyke House, and the Rectory and Chapel of Truro Church; and
WHEREAS, the development of a five-story commercial office building has been
proposed for a certain tract of land owned by Patton, Harris, Rust and Associates,
hereinafter referred to as the "Patton tract," which is bounded on three sides by Main
Street, West Street and Truro Lane and which is also identified as Reference Number
57-#((2)), parcel 79, on the City of Fairfax Tax Map; and
WHEREAS, this proposed development will be detrimental to the character of this
portion of the Old and Historic District and will impair the public's view and
appreciation of certain buildings; and
WHEREAS, there is a present need for public parking and there exists traffic
congestion in the proximity of the intersections of Main Street and West Street and of
West Street and Truro Lane within the City of Fairfax, Virginia; and
WHEREAS, the City of Fairfax, Virginia deems it necessary and essential and in
the interest of the public health, safety and welfare to provide for public parking and
public open space, and to make future road improvements near the intersections of
Main Street and West Street and of West Street and Truro Lane; and
WHEREAS, it is necessary for the City to acquire fee simple title to the Patton
tract; and
WHEREAS, it appears that it may be necessary for the City to exercise its right
of eminent domain in order to acquire fee simple title to the Patton tract;
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY
OF FAIRFAX, VIRGINIA:
1. That there exists a necessity for acquisition of fee simple title to a certain
tract of land owned by Patton, Harris, Rust and Associates, hereinafter referred to as
the "Patton tract", which is bounded on three sides by Main Street, West Street and
Truro Lane and which is also known as number Y7-0((2)), parcel 79, on the City of
Fair/ax Tax Map to preserve the character of the Old and Historic District and to
provide public parking and to make future road improvements; and
2. That the Staff of the City of Fairfax, Virginia is hereby directed to undertake
negotiations to acquire the Patton tract; and
3. That, if the negotiations to acquire the Patton tract are ineffectual, it is
necessary for the City of Fairfax to exercise its power of eminent domain to acquire
the Patton tract; and
#. That if the negotiations to acquire the Patton tract are ineffectual, the Staff
of the City of Fairfax, Virginia is hereby directed to undertake condemnation of the
Patton tract by appropriate legal means.
