R-g6-33 A RESOLUTION TO APPROVE THE REQUEST OF RAINBOW AUTOMOTIVE CORPORATION FOR SPECIAL EXCEPTIONS FROM THE PROVISIONS OF ARTICLE II, DIVISION 6 AND ARTICLE XlII, OF CHAPTER 26 OF THE CODE OF THE CITY OF FAIRFAX FOR PROPERTY LOCATED AT 10925 LEE HIGHWAY AND MORE PARTICULARLY DESCRIBED AS TAX MAP 57-I-((1#))-9 WHEREAS, Rainbow Automotive Corporation has submitted application No. SE- 9-g6-1 requesting the Special Exceptions to the City Code listed below: Section 26-39.2 C: To permit off-street parking area and drive lanes to be separated from structures by an area less than the required width. Section 26-39.2 E (l)(a): To permit a drive lane (ramp) in the building restriction area and a landscaped strip less than the width of the required building restriction area for the zoning district within which said drive lane is located. Section 26-39.2 E (2): To permit a perimeter landscaped area for an off-street parking area of two feet where five feet is required and a landscaped side yard less than the required side yard for structures in the zoning district within which said structure is located. #. Section 26-173(cX2)(a): To permit a side yard less than the ten feet. 5. Section 26-173 (d): To permit a commercial development with landscaped open space of 22.8% where 25% landscaped open space is required. WHEREAS, City Council has carefully considered the application, the recommendation of the staff and testimony received at the public hearing; and WHEREAS, City Council has determined that the proposed Special Exceptions are appropriate because the proposed development meets the requisites established by Fairfax City Code Section 26-39.7 C as follows: 1. Will not result in increased traffic. 2. Will not be contrary to the objectives of the Comprehensive Plan. 3. Will permit reasonable use of the property. #. Will not adversely impact adjacent propertiesl and WHEREAS, the City Council has determined that the proposed Special Exceptions are appropriate because the proposed development meets the requisites established by Fairfax City Code Section 173(fX2) as follows: 1. Will not result in development which is disproportionate to surrounding land uses. 2. Will not adversely affect adjacent residential areas. 3. Will not overburden the existing community facilities. #. Will not be contrary to the objectives of the Comprehensive Plan. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City o!
