R-86-44 WHEREAS, the City Council of the City of Fairfax, Virginia deems it necessary and essential to and in the best interest of the public health, safety and welfare to widen Route 50 and Rt. 236 within the City of Fairfax, Virginia; and WHEREAS, it is necessary for the City of Fairfax to acquire fee simple title to a portion of a certain parcel of land owned by Anthony Costantino, Readi Constantino, Albert Costantino, Angelina Beckman, Bernard Beckman, Joseph Costantino, Jr., Barbara Costantino, Frank Costantino, Doris Costantino, Salvatore Costantino, Clara Costantino, Louis Costantino and Doris Costantino, hereinafter referred to as the "Costantino Parcel", said necessary portion of the parcel is described on the plat attached hereto at Exhibit A and incorporated by this reference, and WHEREAS, the bona fide efforts of the City to acquire the aforesaid necessary portion of the Costantino Parcel from the owner by means of purchase have proved unsuccessful, and the City of Fairfax and the owner cannot agree on the terms of purchase; and WHEREAS, it appears that it may be necessary for the City to exercise its power of eminent domain in order to acquire fee simple title to the aforesaid necessary portion of the Costantino Parcel. R-86-44 NOW, THEREFORE, BE IT CITY OF FAIRFAX, VIRGINIA: 1. The City of Fairfax, Virginia necessary to acquire the fee simple title to RESOLVED BY THE CITY COUNCIL OF THE declares that it is a necessary portion of that certain parcel of land in the City of Fairfax, Virginia owned by Anthony Costantino, Readi Costantino, Albert Costantino, Angelina Beckman, Bernard Beckman, Joseph Costantino, Jr., Barbara Costantino, Frank Costantino, Doris Costantino, Salvatore Costantino, Clara Costantino, Louis Costantino and Doris Costantino said portion of the parcel is described on the plat attached hereto as reference, so that the Route 236. 2. Exhibit "A" and incorporated by this City of Fairfax may widen Route 50 and The City of Fairfax, Virginia declares that since the owner of the parcel and the City of Fairfax have been unable to agree on terms of purchase it may be necessary for the City of Fairfax to exercise its powers of eminent domain to acquire the necessary portion of said parcel as designated in the attached plat. 3. The City of Fairfax, Virginia hereby authorizes the City Attorney to acquire the necessary portion of the Costantino parcel by appropriate legal means, including condemnation.
