WHEREAS, the City Council of the City of Fairfax, Virginia
deems it necessary and essential to and in the best interest of
the public health, safety and welfare to widen Jermantown Road
within the City of Fairfax, Virginia; and
WHEREAS, it is necessary for the City of Fairfax to acquire
fee simple title to a portion of a certain parcel of land owned
by Shell Oil Company, a Delaware corporation, hereinafter
referred to as the "Shell Oil Company/Jermantown Road Parcel",
said necessary portion of the parcel is described on the plat
attached hereto as Exhibit "A" and incorporated by this
reference, and
WHEREAS, the bona fide efforts of the City to acquire the
aforesaid necessary portion of the Shell Oil Company/Jermantown
Road Parcel from the owner by means of purchase have proved
unsuccessful, and the City of Fairfax and the owner cannot agree
on the terms of purchase; and
WHEREAS, it appears that it may be necessary for the City to
exercise its power of eminent domain in order to acquire fee
simple title to the aforesaid necessary portion of the Shell Oil
Company/Jermantown Road Parcel.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE
CITY OF FAIRFAX, VIRGINIA:
1. The City of Fairfax, Virginia declares that it is
necessary to acquire the fee simple title to a necessary portion
of that certain parcel of land in the City of Fairfax, Virginia

owned by Shell Oil Company, a Delaware corporation, said portion
of the parcel is described on the plat attached hereto as Exhibit
"A" and incorporated by this reference, so that the City of
Fairfax may widen Jermantown Road.
2. The City of Fairfax, Virginia declares that since the
owner of the parcel and the City of Fairfax have been unable to
agree on terms of purchase it may be necessary for the City of
Fairfax to exercise its
