R-86-46 WHEREAS, the City Council of the City of Fairfax, Virginia deems it necessary and essential to and in the best interest of the public health, safety and welfare, to widen Route 123 and Routes 50 and 29/211 within the City of Fairfax, Virginia; and WHEREAS, it is necessary for the City of Fairfax to acquire fee simple title to a portion of a certain parcel of land owned by Dick Keller Enterprises, Inc., a Virginia Corporation, hereinafter referred to as the "Keller Parcel", said necessary portion of the parcel is described on the plat attached hereto as Exhibit "A" and incorporated by this reference; and WHEREAS, the bona fide efforts of the City of Fairfax to acquire the aforesaid necessary portion of the Keller Parcel from the owner by means of purchase have proved unsuccessful and the City of Fairfax and the owner cannot agree on the terms of purchase; and WHEREAS, it appears that it may be necessary for the City of Fairfax to exercise its power of eminent domain in order to acquire fee simple title the Keller Parcel. NOW, THEREFORE, BE IT CITY OF FAIRFAX, VIRGINIA: to the aforesaid necessary portion of RESOLVED BY THE CITY COUNCIL OF THE 1. The City of Fairfax, Virginia declares that it is necessary and essential to the health, safety and welfare of the R-86-46 public to acquire the fee simple title to a necessary portion of that certain parcel of land in the City of Fairfax, Virginia owned by Dick Keller Enterprises, Inc., a Virginia corporation, said portion of the parcel is described on the plat attached hereto as Exhibit "A" and incorporated by this reference, so that the City of Fairfax may widen Route 123 and Rts. 50 and 29/211. 2. The City of Fairfax, Virginia declares that since the owner of the parcel and the City of Fairfax have been unable to agree on terms of purchase it may be necessary for the City of Fairfax to exercise its powers of eminent domain to acquire the necessary portion of said parcel as designated on the attached plat. 3. The City of Fairfax, Virginia hereby authorizes the City Attorney to acquire the necessary portion of the Keller Parcel by appropriate legal means, including condemnation.
