19850709 r-85-14RESOLUTION NO. WHEREAS, the City Council of the City of Fairfax, Virginia, is concerned that applying the Virginia Tort Claims Act to localities will seriously impair the ability of local governments to obtain insurance coverage, and ~ WHEREAS, in addition to a probable curtailment in available insurance, the City is concerned that such insurance may not be at affordable rates, and WHEREAS, under current law, cities already are liable for torts arising out of non traditional (proprietary) governmental services, and WHEREAS, application of the Act would increase the exposure of localities to possibly frivolous lawsuits and increase costs to localities in terms of time, personnel and money, and WHEREAS, any benefits of bringing local governments under the tort claims act are far outweighed by the negative impacts, NOW, THEREFORE, BE IT RESOLVED THAT: Because of a significant adverse impact, the Fairfax City Council hereby for- mally states its opposition to application of the Virginia Tort Claims Act to local governments and urges that any effort to enact legislation to apply this doctrine be defeated.
