19840124 r-84-2RESOLUTION NO. R-84-2 REJECTION OF BIDS ON HUNTER MILL WATER MAIN CONTRACTS WHEREAS, the City Council of the City of Fairfax, on December 13, 1983, decided to reject all bid proposals on the Hunter Mill Water Main Contract submitted in response to the City's request for bids advertised on September 26, 1983; and WHEREAS, the City Council desires to make the reasons therefore a matter of public record; NOW THEREFORE BE IT RESOLVED THAT: The City Council of the City of Fairfax determined it to be in the best interest of the City to reject all of the bids described above and to re-issue the bid because (1) it was unclear which of the two lowest bidders was in fact the "lowest bidder" because of the very small difference in the contract prices set forth, (2) it was and is uncertain whether the Virginia and Fairfax City Codes allow preference to in-state bidders in the event that the difference between the lowest competing bids is only nominal, and (3) the fact that pending and/or potential litigation related to these and other issues pertinent to the award of this contract promised to delay the construction of this water main for a considerable amount of time and to result in significant expense, all to the detriment of the citizens of the City of Fairfax.
