BE IT RESOLVED, that pursuant to Section Ol#(h) of the Internal Revenue Code
and City Ordinances Sections 17-16-35 and 17-16.1-30, the Council agrees to pick up
Eligible Employee contributions to the Retirement Plan for Employees of the City of
Fairfax, Virginia, and the Retirement Plan for Police and Fire Employees of the City
of Fairfax, Virginia, and to make corresponding reductions in the employees' salaries;
and provided, however, that this Resolution shall be void with respect to both plans
unless within a reasonable period of time satisfactory assurance is received from the
Virginia Supplemental Retirement System ("VSRS") that such "pick-up" will not
diminish employees' eventual benefits under VSRS; and further
BE IT RESOLVED, that the appropriate persons are hereby authorized and
directed to take such actions, including but not limited to corresponding with VSRS,
drafting amendments to the Retirement Plan for Employees of the City of Fairfax,
Virginia and the Retirment Plan for Police and Fire Employees of the City of Fair-
fax, Virginia, and obtaining rulings and/or determination letters from the Internal
Revenue Service, as may be necessary or desirable pursuant to the foregoing Resolu-
tion.
