WHEREAS, the present traffic congestion in the proximity of
the Fairfax County Judicial Center creates an adverse impact on
the flow of traffic on Route 123 within the City of Fairfax,
Virginia; and
WHEREAS, the City Council of the City of Fairfax, Virginia
deems it necessary and essential and in the interest of the
public health, safety and welfare to construct an additional lane
of traffic along the east side of Route 123 between Armstrong
Street and Judicial Drive within the City of Fairfax, Virginia in
order that a left hand turn lane will be created in the current
northbound lane of Route 123 at the intersection of Route 123 and
Judicial Drive; and
WHEREAS, it is necessary for the City to acquire fee simple
title to a portion of a certain tract of land, hereinafter
referred to as the Adams-Porter Tract, and two easements across
the remainder, consisting of a temporary slope construction
easement and a utility easement as the same are designated on a
plat attached hereto and incorporated herein by reference;
WHEREAS, the bona fide efforts of the City to acquire
aforesaid the necessary portion of the Adams-Porter Tract and the
easements across the remainder from the owners by means of
purchase have proved unsuccessful; and
WHEREAS, it appears that it will be necessary for the City
to exercise its power of eminent domain in order to acquire fee
simple title to that portion of the Adams-Porter Tract and two
required easements across the remainder as indicated on that
attached plat.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE
CITY OF FAIRFAX, VIRGINIA:
1. The City of Fairfax, Virginia declares the necessity
for acquisition of the fee simple title to a portion of that
certain parcel of land in the City of Fairfax, Virginia known as
the Adams-Porter Tract for construction of an additional lane of

traffic along Route 123 and in conjunction therewith two
easements across the remainder consisting of a temporary slope
construction easement for embankment purposes and a utility
easement of utility purposes.
2. The City of Fairfax, Virginia declares the necessity
for the exercise of its powers of eminent domain to acquire the
necessary portion of said parcel along with two easements across
the remainder, consisting of a temporary slope construction
easement and a utility easement, as the same are designated on
the attached plat.
3. The City of Fairfax, Virginia authorizes the City
Attorney to acquire the necessary portion of the Adams-Porter
Tract and the required easements by appropriate legal means and
to file and pursue condemnation actions for this land and
easements.
