19820914 r-82-29 RESOLUTION R- 82- 29 INDEMNIFICATION OF FORMER MAYOR AND COUNCIL MEMBERS WHO ARE PARTIES IN LONG vs. CITY COUNCIL WHEREAS the case of Long vs. City Council specifically names former Mayor Frederick W. Silverthorne, former Councils John P. Perrin and William M. Ca]nan, and current Councilmember Carl J. Heu~ner as defendants, and WHEREAS the allegations against the defendants are that they performed acts which have caused damages to the Longs and the acts alleged are those which the defendants performed as members of the City Council of the City of Fairfax in their capacity as legislators, and WHEREAS at the time that these actions occurred, the City of Fairfax did not have insurance to cover acts or cmissions of the members of the City Council in performance of their duties, and WHEREAS the City Council of the City of Fairfax believes that all of the defendants listed above should be indemnified and held harmless frc~n damages and costs resulting frcm actions taken within the scope of their duties as Mayor and Councilmembers with respect to the case of Long vs. City Council, NOW THEREFORE, BE IT RESOLVED that for the above stated reasons, former Mayor Frederick W. Silverthorne, former Councilmembers John P. Perrin and William M. Calnan, and current Councilmember Carl J. H~mner shall be indemnified by the City of Fairfax and held harmless frc~ all losses and damages arising out of the case of Long vs. City Council, including, but not limited to, attorneys fees, costs and monetary relief granted to the Longs against such persons.
