19821123 r-82-33LAW OFI:'I CES ALONEY AND CHESS UNIVERSITY DRIVE IRFAX, VIRGINIA 220~0 R-82-33 RESOLUTION CITY OF FA IRFAX RESOLUTION CONCERNING CONDEMNATION OF PROPERTY OF THE FORMER WARREN CONSTRUCTION CORPORATION WHEREAS, the City of Fairfax, Virginia, owns two sanitary system related pumping stations on a parcel of land located in the Warren Woods Subdivision and belonging to the former Warren Construction Corporation; WHEREAS, it would be in the best interests of said City to acquire the parcel upon which the pumping stations are presently located; WHEREAS, it appears that it will be necessary for the City to exercise its right of eminent domain in order to acquire said parcel; NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF FAIRFAX, VIRGINIA: 1. The City of Fairfax, Virginia, declares the public necessity for the condemnation of a certain parcel of land in the City of Fairfax, Virginia, hereinafter listed, for the continued operation of its sanitary sewer and water system; 2. The City of Fairfax, Virginia, declares the necessity for the exercise of its powers of condemnation to acquire said parcel; 3. The City of Fairfax, Virginia, authorizes its City Attorney to proceed to initiate said condemnation proceedings by appropriate legal means to this end; and 4. A description of the said parcel which is the subject of the condemnation procedure of this resolution is described as follows: Ail that lot or parcel of land located on the south side of Byrd Drive containing 7827 square feet designated as the OUTLOT on the west end of BLOCK H as shown on the plat and survey of Warren Woods Section Three prepared by Walter L. Ralph, C.L.S. dated July 9, 1954, attached to a Deed of Dedication dated December 16, 1954, of record in the Office of the Clerk of the Circuit Court of Fairfax County in Deed Book 1256 at Page No. 523.
