19810609 r-81-9 RESOLUTION R-81-9 WHEREAS, the present traffic congestion in the proximity of the Fairfax County government complex creates an adverse impact on the flow of traffic within the City of Fairfax, Virginia; and ~EREAS, the City of Fairfax, Virginia deems it necessary and essential and in the interest of the public health, safety and welfare to construct a public street with sidewalk, curb and gutter providing additional access to the Fairfax County government complex connecting Main Street with Page Avenue (hereinafter referred to as "Page Avenue Connector"); and WHEREAS, it is necessary for the said City to acquire fee simple title to a portion of a certain tract of land, hereinafter referred to as the ,,Higginbotham Tract," and storm drainage and temporary construction easements across the remainder all as designated on a plat attached hereto and incorporated herein by reference; and WHEREAS, the bona fide efforts of said City to acquire said portion of the Higginbotham Tract and necessary storm drainage and temporary construction easements across the remainder from the owners by means of purchase have proved unsuccessful; and WHEREAS, it appears that it will be necessary for said City to exercise its right of eminent domain in order to acquire fee simple title to a portion of the Higginbotham Tract and necessary storm drainage and temporary construction easements across the remainder; NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF FAIRFAX, VIRGINIA: 1. The City of Fairfax, Virginia, declares the necessity for acquisition of fee simple title to a portion of a certain tract of land known as the Hig ginbo tham Tract and storm drainage and temporary construction easements across the remainder for the public street purposes involving construction of the Page Avenue Connector; and 2. The City of Fairfax, Virginia, declares the necessity for the exercise of its powers of condemnation to acquire said portion of the Higginbotham Tract and storm drainage and temporary construction easements; and 3. The City of Fairfax, Virginia, authorizes its City Attorney to proceed to acquire a portion of the said Higginbotham Tract and necessary storm drainage and temporary construction easements by appropriate legal means and to file and pursue condemnation actions to this end; and 4. The portion of the said Higginbotham Tract to be taken by eminent domain and necessary storm drainage and temporary construction easements which are the subject of this resolution are designated on a plat attached hereto and incorporated herein by reference.
