WHEREAS, a settlement has been proposed in the case of
Miller and Smith, Inc., v. the Fairfax City Council, City of
Fairfax, Virginia, et al., In Chancery No. 56129; and
WHEREAS, such settlement provides for the dismissal with
prejudice of such case upon the payment of $27,492.47 from
the City of Fairfax to Miller and Smith, Inc.;
NOW, THEREFORE, BE IT RESOLVED that this settlement as
set forth above is hereby approved by the City Council for the
City of Fairfax, Virginia.
