R-78-3 RESOLUTION BY THE CITY COUNCIL OF THE CITY OF FAIRFAX, VIRGINIA TO REQUEST THE APPROPRIATION OF STATE FUNDS FOR THE INITIATION OF A LITTER CONTROL PROGRAM UNDER THE VIRGINIA LITTER CONTROL ACT. WHEREAS, there exists a Litter Control Act of the Commonwealth of Virginia, the intent of which is to inhibit the accumulation of all types of litter to maintain a healthful, clean and beautiful environment, through a State developed and coordinated program of education, control, prevention and elimination; and WHEREAS, the Division of Litter Control, Department of Conservation and Economic Development of the Commonwealth of Virgini~ is charged with implementing the mandates of this law; and WHEREAS, Section 10-206(J) of the Litter Control Act states that at least fifty percent of the funds appropriated must be expended through grants to localities for the purpose of carrying out anti-litter programs; and WHEREAS, it is required that each locality make formal petition for these funds to the Department of Conservation and Economic Development, Division of Litter Control; NOW, THEREFORE BE IT RESOLVED, that the City Council of the City of Fairfax, Virginia petitions that: (1) The City of Fairfax be considered for receiving an appropriation of State grant funds for the initiation of a litter control program under the Virginia Litter Control Act (chapter 19, title 10, Code of Virginia); and (2) The City of Fairfax hereby agrees to use all funds, if its application is accepted and program approved, in a program for the enforcement of anti-litter ordinances and statutes, and/or a program designed for litter prevention and/or elimination.
