R-78-21 RESOLUTION OF AMENDMENT TO THE REVISED RETIRE- MENT PLAN FOR EMPLOYEES OF THE CITY OF FAIRFAX, VIRGINIA AND THE REVISED RETIREMENT PLAN FOR POLICE EMPLOYEES OF THE CITY OF FAIRFAX, VIRGINIA TO PROVIDE FOR THE INCLUSION OF MEMBERS OF THE DEPARTMENT OF FIRE AND RESCUE SERVICES IN THE REVISED RETIREMENT PLAN FOR POLICE EMPLOYEES OF THE CITY OF FAIRFAX, VIRGINIA WHEREAS, the Council of the City of Fairfax, Virginia has adopted a Revised Retirement Plan for Employees of the City of Fairfax, Virginia, as amended and restated on July 20, 1976; and, WHEREAS, the Council of the City of Fairfax, Virginia has adopted a Revised Retirement Plan for Police Employees of the City of Fairfax, Virginia, as amended and restated on July 20, 1976; and, WHEREAS, the Council of the City of Fairfax, Virginia estab- lished a Department of Fire and Rescue Services on May 1, 1978; and, WHEREAS, it is the desire of the Council of the City of Fairfax, Virginia to include salaried members of the Department o Fire and Rescue Services (firefighters) as eligible employees unde the Revised Retirement Plan for Police Employees of the City of Fairfax, Virginia, as amended and restated on July 20, 1976, effective as of May 1, 1978, and to amend the aforesaid revised retirement plans accordingly. NOW, THEREFORE, BE IT RESOLVED by the Council of the City of Fairfax, Virginia that salaried members of the Department of Fire and Rescue Services (firefighters) shall be included as eligible employees under the Revised Retirement Plan for Police Employees of the City of Fairfax, Virginia, as amended and restated on July 20, 1976, and, accordingly, the aforesaid revised retire- ment plans be, and the same hereby are, amended effective as of May 1, 1978 as follows: · .. R-78-21 1. The definition of "Eligible Employee" as set forth in Article I, paragraph 9 of the Revised Retirement Plan for Employees of the City of Fairfax, Virginia, as amended and restated on July 20, 1976, is hereby amended by deleting the same in its entirety and substituting in its place and stead the following. 9. Elisible Employee means any person regularly employed by the City on a full time basis, other than a member of the Police Department having police powers or a salaried member of the Fire and Rescue Services Department (firefighter), whose customary employment is for more than thirty hours per week and for more than five months per year. 2. The definition of "Plan" as set forth in Article I, paragraph 1 of the Revised Retirement Plan for Police Employees of the City of Fairfax, Virginia is hereby amended by deleting the same in itt entirety and substituting in its place and stead the following: 1. Plan means the Revised Retirement Plan for Police and Fire Employees of the City of Fairfax, Virginia, as contained herein or as duly amended. 3. The definition of "Eligible Employee" as set forth in Article I, paragraph 9 of the Revised Retirement Plan for Police Employee~ of the City of Fairfax, Virginia is hereby amended by deleting the same in its entirety and substituting in its place and stead the following: 9. The caption "Revised Retirement Plan for Police Employees of the City of Fairfax, Virginia," as the title of the said revised retirement plan is hereby amended to read "Revised Retirement Pla~ for Police and Fire Employees of the City of Fairfax, Virginia." · R-78-21 5. The Introduction as set forth on page 1 of the Revised Retirement Plan for Police Employees of the City of Fairfax, Virginia, as amended and restated on July 20, 1976, shall be revised to conform to the amendments to the said retirement plan as more particularly set forth hereinabove. BE IT FURTHER RESOLVED that James E. Anderson and Barry B. Baker, having elected to accept an offer made to all experienced members of the Fire and Rescue Services Department to purchase a maximum of 5 years credit in the City's Revised Retirement Plan for Police and Fire Employees, shall be permitted to enter the plan as participants and to pay into the plan a certain amount of monies reflecting accumulated contributions as follows: James E.
