19770505 r-77-6RESOLUTION No. ~-77-6 RESOLUTION OF THE COUNCIL OF THE CITY OF FAIRFAX, VIRGINIA, CONCERNING THE NECESSITY OF ACQUIRING LAND FOR PUBLIC USE AS A MUNICIPAL FIRE STATION FACILITY. WHEREAS, it is necessary and essential as a matter of public necessity and public welfare, and the public interest and conven- ience requires, that a permanent facility be acquired by the City of Fairfax, Virginia, for the protection from fire of life and property within the City; and, WHEREAS, there is within the City of Fairfax, Virginia, a certain tract or parcel of land more particularly described herei after which is suitable for providing a permanent facility for fire protection; and, WHEREAS, the hereinafter described tract or parcel of land is owned by Robert Louis Stephens and Gladys Estora Stephens, his wife; and, WHEREAS, the City of Fairfax, Virginia, desires to acquire said tract or parcel of land by purchase or condemnation for the purpose of providing the public with protection from fire by the establishment and maintenance of a municipal fire station facilit NOW, THEREFORE, BE IT R~SOLVED BY THE CITY COUNCIL OF THE CITY OF FAIRFAX, VIRGINIA: 1. That the City of Fairfax, Virginia, declares the necessi for the acquisition of a certain parcel of land more particularly described hereinafter for the purpose of providing the public wit protection from fire by the establishment and maintenance of a municipal fire station facility. 2. That pursuant to the provision of Section 2.7 of the Charter of the City of Fairfax, Virginia, as amended, and Titles ~,~~ amended, the RESOLUTION No. ~-77-6 RESOLUTION OF THE COUNCIL OF THE CITY OF FAIRFAX, VIRGINIA, CONCERNING THE NECESSITY OF ACQUIRING LAND FOR PUBLIC USE AS A MUNICIPAL FIRE STATION FACILITY. That the City of Fairfax, Virginia, declares the nece the acquisition of a certain parcel of land more particularly described hereinafter for the purpose of providing the public wit protection from fire by the establishment and maintenance of a municipal fire station facility. 2. That pursuant to the provision of Section 2.7 of the Charter of the City of Fairfax, Virginia, as amended, and Titles 15.1, 25.1 and 33.1 of the 1950 Code of Virginia, as amended, th City of Fairfax, Virginia shall acquire by purchase or condemnati fee simple title to that certain tract or parcel of land more ' ~. · ~. R-77-6 particularly described hereinafter for the purpose of protection from fire of life and property within the City, to-wit: All that certain tract or parcel of land containing 49,595 square feet or 1.1386 acres of land, being part of Lot Number One of Section Four of the Boulevard Courts Subdivision, more particularly described as follows: Beginning at a point, said point being on the north right of way line of Lee Highway, Route 29-211-50, said point also being the Southwest corner to Lot 2 and the said Southeast corner to Lot l; thence, departing from said point along the north right of way line of Lee Highway S 87°44'30'' W, 244.90 feet to a point; thence, continuing along the same right of way line S 82°27'10'' W, 90.00 feet to a point; thence, leaving said point and departing in a northward direction through the said Lot 1 the following courses and distances: N $3°27'10'' E, 70.00 feet, N 40°57'10" E, 85.00 feet, N 32°42'10'' E, 110.00 feet, N 25°36'57'' Es 71.21 feet, to a point in the north property line of the said subdivision; thence along the north property line N 85024'00'' E, 112.00 feet to a corner to the said Lot 1 and common to Lot 2; thence, departing along a property line common to Lot 1 and Lot 2 S' 4036'00'' E, 250.97 feet to the point of.beginning. The said described parcel containing 49,595 square feet or 1.1386 acres of land. 3. That the City Attorney be, and he hereby is, authorized and directed to negotiate with the owners of said land for its purchase and upon failure to agree upon a reasonable price for said land, to institute condemnation proceedings for the purpose of acquiring said land in the manner provided by law.
