19760720 r-76-17RESOLUTION NO. R-76-17 WHEREAS, Chapters 13 and 18 of the Zoning Ordinance of the City of Fairfax, Virginia, provide for the establishment and control of archi- tectural control districts within the City of Fairfax, Virginia; and WHEREAS, the Charter of the City of Fairfax, Virginia, was amended by the General Assembly of Virginia during its 1976 session to authorize and provide further for the creation and control of architectural control districts within the City of Fairfax, Virginia; and, WHEREAS, it has come to the attention of the Council of the City of Fairfax, Virginia, that certain revisions and additions to the existing chapters are necessary; and, WHEREAS, certain recently enacted sections of the 1950 Code of Virginia, as amended, provide for the creation of architectural control districts other than pursuant to authority contained in municipal charters; and, WHEREAS, it is the desire of the Council to revise and re-enact Chapters 13 and 18 of the Zoning Ordinance relating to architectural con- trol districts. NOW, THEREFORE, BE IT RESOLVED by the Council of the City of Fairfax, Virginia, that Chapters ]3 and 18 of the Zoning Ordinance be, and they hereby are, referred to the Planning Commission of the City of Fairfax, Virginia, and the Commission is directed to report its recommendations to the Council on or before the second meeting of the Councll in September, 1976. In its review of the said Chapters, the Planning Commission is directed to consider necessary revisions and additions to the present Chapters, to correct existing deficiencies and to conform the same to the recent eharter amendments. In addition, the Planning Commission is directed to consider and make recommendations to the Council concerning the revision of the present Chapters to reflect the restrictions and provisions of Sections 15.1-503.2 and 503.3 of the 1950 Code of Virginia, as amended, relating to the creation of architectural control districts other than pursuant to authority contained in municipal charters and such other re- visions as the Planning Commission may deem appropriate.
