R-76-21 RESOLUTION OF THE CITY COUNCIL OF THE CITY OF FAIRFAX, VIRGINIA CONCERNING THE NECESSITY OF ACQUIRING A DEDICATION AND EASEMENT OF LAND FOR PUBLIC USE WHEREAS, the City of Fairfax, Virginia plans to improve its sidewalk and road system by constructing certain new side- walks, curbs, gutters and by widening existing roadway in the vicinity of 4057 Chain Bridge Road; WHEREAS, in order to carry out the above improvements it is necessary for the City to acquire a five foot easement for public street and utilities (to include a public utility "overhang" easement) and a ten foot dedication in front of 4057 Chain Bridge Road, as is shown on the attached plat for Lot 48 of the Barbour Estate dated July 15, 1976; WHEREAS, it appears that it will be necessary for the City to exercise its right of eminent domain in order to acquire said easement and dedication; NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF FAIRFAX, VIRGINIA: 1. That the City of Fairfax, Virginia declares the necessity for the acquisition of a five foot easement and a ten foot dedi- cation for public street, sidewalk, curb and gutter improvements in front of 4057 Chain Bridge Road as is shown on the afore- mentioned and attached plat for the public convenience; 2. That the City of Fairfax, Virginia declares the necessity of the exercise of its powers of condemnation to acquire said dedication and easement 3. That the City of Fairfax, Virginia authorizes its City Attorney to proceed to acquire said easement by appropriate R-76-21 legal means and to file and pursue condemnation action to this end.
