19720606 r-72-10 R-72-10 RESOLUTION WHEREAS Maple Street in the City of Fairfax, Virginia has been relocated in part at and near its intersection with Virginia Route 236 adjacent to the property of Oscar D. and Glenn S. Weber; and WHEREAS a portion of Maple Street as formerly located adjacent to the said property of Oscar D. and Glenn S. Weber is no longer used or needed for public street purposes; and WHE~ there is now pending and undeterm~ined a condemnation< action by the Commissioner of Highways of the Commonwealth of Virginia against Oscar D. and Glenn S. Weber in connection with the relocation of Maple Street; and WHEREAS the City of Fairfax, Virginia, under agreement with the Virginia Department of Highways, is responsible for a portion of the costs of said project; and WHEREAS the said Oscar D. and Glenn S. Weber are desirous of obtaining title to the said section of Maple Street no longer used or necessary for public street purposes as a part of a settlement of the said condemnation action. NOW THEREFOREBE IT RESOLVED by the City Council of the City of Falrfax, Virginia that the said City Council has no objection to the closing and abandonment of a section of Maple Street shown as an area cross-hatched in red on the attached plat and the conveyance to or acquisition by Oscar D. and Glenn S. Weber as a part of the settlement of a condemnation action by the Commissioner of Highways of the Commonwealth of Virginia against Oscar D. and Glenn S. Weber provided that all steps necessary in connection therewith can be properly and legally performed to the satisfaction of the City Attorney of the City of Fairfax, Virginia.
