19720321 r-72-5RESOLUTION R-7 2~5 WHEREAS, the City of Fairfax, Virginia, plans to improve its sanitary sewer system by constructing certain new sewer lines; and WHEREAS, it is necessary for the said City to acquire certain easements for such purposes; and WHEREAS, it appears that it will be necessary for the City to exercise its right of eminent domain in order to acquire certain of the said easements; NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF FAIRFAX, VIRGINIA: 1. The City of Fairfax, Virginia, declares the necessity for acquisition of easements across certain parcels of land in the City of Fairfax, Virginia, herein- after listed, for the improvement of its sanitary sewer system; 2. The City of Fairfax, Virginia, declares the necessity for the exercise of its powers of condemnation to acquire said easements; 3. The City of Fairfax, Virginia, authorizes its City Attorney to proceed to acquire said easements by appropriate legal means and to file and pursue condemnation actions to this end; and 4. The said easements which are the subject of this resolution are the following: An easement shown on the attached plat across certain property owned by Will H. and Kaletah N. Carroll, said property having been acquired by deed recorded in Deed Book 1400, at page 287, among the land records of Fairfax, Virginia. An easement shown on the attached plat across certain property owned by James Keith, Trustee, said property having been acquired by deed recorded in Deed Book 2938, at page 646, among the land records of Fairfax, Virginia. An easement shown on the attached plat across certain property owned by N.T. and L.B. Higginbotham, said property having been acquired by deed recorded in Deed Book 760 at page 343, and'Deed Book 1047 at page 260, among the land records of Fairfax, Virginia. An easement shown on the attached plat across certain property owned by N.T. and L.B. Higginbotham, said property having been acquired by deed recorded in Deed Book 1513, at page 308, among the land records of Fairfax, Virginia. An easement shown on the attached plat across certain property owned by Fairfax Nursing Home, said property having been acquired by deed recorded in Deed Book 2327, at page 31, among the land records of Fairfax, Virginia.
