19711102 r-71-25R-71-25 RESOLUTION WHEREAS, the City of Fairfax, Virginia, plans to improve its sanitary sewer system by constructing certain new sewer lines; and WHEREAS, it is necessary for the said City to acquire certain easements for such purposes; and WHEREAS, it appears that it will be necessary for the City to exercise its right of eminent domain in order to acquire certain of the said easements; NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF FAIRFAX, VIRGINIA: 1. The City of Fairfax, Virginia, declares the necessity for acquisi- tion of easements across certain parcels of land in the County of Fairfax, Virginia, hereinafter listed, for the improvement of its sanitary sewer system; 2. The City of Fairfax, Virginia, declares the necessity for the exercise of its powers of condemnation to acquire said easements; 3. The City of Fairfax, Virginia, authorizes its City Attorney to proceed to acquire said easements by appropriate legal means and to file and pursue condemnation actions to this end; and 4. The said easements which are the subject of this resolution are the following: An easement shown on the attached plat across certain property owned by Frank D. Swart and Ambrose Kiley, Trustees, said property having been acquired by deed recorded in Deed Book 2732, at page 702 among the land records of Fairfax, Virginia. Adopted: November 2, 1971.
