WHEREAS, the City of Fairfax, Virginia, plans to
improve the storm drainage system within the boundaries of said
City; and
WHEREAS, it is necessary for the said City to acquire
a storm drainage easement for such purposes; and
WHEREAS, it appears that it will be necessary for the
City to exercise its right of eminent domain in order to acquire
the said easement;
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF
THE CITY OF FAIRFAX, VIRGINIA:
1. The City of Fairfax, Virginia, declares the neces-
sity for acquisition of an easement on property hereinafter de-.
scribed for the improvement of the storm drainage system within
said City;
2. The City of Fairfax, Virginia, declares the neces-
sity for the exercise of its powers of condemnation to acquire an
easement on said properties, hereinafter described;
3. The City of Fairfax, Virginia, authorizes its City
Attorney to proceed to acquire the easement on said property by
appropriate legal means and to file and pursue condemnation
actions to this end; and
4. The said property which is the subject of this
resolution is described as follows:
959.59 square feet belonging to Howard B. and
Hazel V. Gray, being part of the same land
acquired by them by deed recorded in Deed Book
1934 at page 276 among the land records of
Fairfax County, more particularly shown on a
pl~t of said property and dated December 5,
1969, prepared by the Engineering Diyision
of the City of Fairfax, Virginia, which is
incorporated herein by reference.
Passed by the City Council of the City of Fairfax,
Virginia, in a regular meeting this sixth day of January, 1970.
