19700120 r-70-02 RESOLUTION R-70-2 WHEREAS, it is hoped that substantial amendments to the Constitution of Virginia which may lead to more flexible forms of local government will become effective on July 1, 1971; and WHEREAS, Senate Bill No. 5 was prefiled with the General Assembly of Virginia (by Senator Robert C. Fitzgerald) to amend the Code of Virginia by adding Section 15.1-1056.1 prohibiting an- nexation of any part of any urban county which has a population in excess of 400,000 without consent of its governing body; NOW THEREFORE BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF FAIRFAX, VIRGINIA, that the General Assembly of Virginia is urged to defeat Senate Bill No. 5 for the following reasons: 1. Senate Bill No. 5, while couched in general language, is in fact special legislation designed for Fairfax County alone and involves a piecemeal approach to the important problem of solving metropolitan problems and sets a bad precedent for the future han- dling of local government problems i~ Virginia; and 2. Senate Bill No. 5 would deny citizens in affected areas, even more than the existing general law governing annexation, any voice in determining which jurisdiction will govern them because only one member of the Fairfax County Board of Supervisors is elected at large; and 3. Given the special facts existing in northern Virginia, enactment of Senate Bill No. 5 would promote inter-jurisdictional divisiveness rather than foster cooperation among jurisdictions of equal stature; and ' R-70-2 -2 4. Enactment of Senate Bill No. 5 would encourage Fairfax County to ignore the demand for services in areas adjacent to the cities and towns within and bordering Fairfax County.
