At a meeting of the City Council Of Fairfax, Virginia, held this
day of Aucjust , 19 69 , the following resolution was adopt-
WHEREAS, the Highway Department proposes to construct or otherwise
improve a section of Route 50 and Route 236, Projects: 0050-151-101, C-501
and 0236-151-101, C-501; and
WHEREAS, the City Council is responsible for making arrangements for
the adjustment and/or relocation of certain utilities and for the installa-
tion of any new utility facilities;
NOW THEREFORE, BE IT RESOLVED, that the City Council of Fairfax,
hereby certifies that all arrangements have been made for the relocation
and/or adjustment of said utility facilities, and for the installation of
any new facilities. In the event of any legally valid claim from the road
contractor for delays or interference caused by said utilities, the City agrees
to be responsible for such claims provided it may legally do so and provided
further that City can require the utilities involved to reimburse the City for
said claims, and further provided the City is advised in writing by the High-
way Department at the time of delay that the Road Contractor intends to file
a claim.
