R-66-1
WHEREAS, the Loudoun County Sanitation Authority ("the Authority"),
the Board of Supervisors of Loudoun County ("the County"), and the City
of Fairfax, Virginia, formerly the Town of Fairfax, Virginia ("the City")
entered into an Agreement dated September 22, 1959, with respect to the
utilization of Goose Creek as a source of water supply; and
WHEREAS, the said parties entered into an Agreement dated Sept-
ember 13, 1960, for the purpose of defining a water rate formula for the
sale of water from the said source by the City; and
WHEREAS, it is deemed to be in the best interests of all of the
parties to the aforementioned agreements to amend same with respect to
certain time periods and dates contained in the agreements,
NOW BE IT THEREFORE RESOLVED,
1. That the Agreement dated September 22, 1959, by and between the
Loudoun County Sanitation Authority, the Board of Supervisors of Loudoun
County, and the City of Fairfax, Virginia, formerly the Town of Fairfax,
Virginia, be amended as follows:
(a) Paragraph 3. Delete the first sentence and in lieu thereof
insert the following: "The cost of water to be furnished by
the Town to the Authority shall be in accordance with the schedule
set out above through December 31, 1966, and shall be reviewed
and redetermined at such time and annually thereafter."
2. That the Agreement dated SePtember 13, 1960, by and between the
Loudoun County Sanitation Authority, the Board of Supervisors of Loudoun
County, and the City of Fairfax, Virginia, formerly the Town of Fairfax,
Virginia, be amended as follows:
(a) Section B. In the last sentence delete "the anniversay date of
termination of the first five-year period" and in lieu thereof
insert "January 1, 1967."
(b) Section G. Delete "the first five-year period following com-
pletion of the project" and in lieu thereof insert "December 31,
1966."
3. That both of the aforementioned agreements be amended by
deleting "Town of Fairfax" and. inserting"City of Fairfax" wherever
such language might appear.
4. That the Mayor of the City of Fairfax is hereby authorized
to execute an amendment to each of the aforesaid agreements in
accordance with this resolution.
