2023-01ORDINANCE NO.2023-01 AN ORDINANCE AUTHORIZING "QUICK -TAKE" CONDEMNATION PROCEEDINGS FOR THE ACQUISITION OF CERTAIN PUBLIC RIGHT-OF-WAY IN FEE SIMPLE, TOGETHER WITH VARIOUS PERMANENT AND TEMPORARY EASEMENTS, ON PROPERTY OWNED BY FAIRFAX COURT LIMITED PARTNERSHP AT 4040 JERMANTOWN ROAD, AND HAVING TAX MAP NO. 56-2-02-002. WHEREAS, the City has undertaken to install and construct certain roadway and ancillary improvements to connect Government Center Parkway to Jermantown Road, further identified as the "Government Center Parkway Extended Project" (the "Project"); and WHEREAS, the City has determined that there is a public need to acquire the following right-of-way (in fee simple) and permanent and temporary easements on portions of real property located within the municipal boundaries of the City, owned by Fairfax Court Limited Partnership ("Owner"), located at 4040 Jermantown Road, and having Tax Map No. 56-2-02-002 (the "Property"): (i) approximately 48,404 square feet (1.1112 acres) of the subject property for public right-of-way (fee simple); (ii) approximately 554 square feet (0.0127 acres) of the subject property for a permanent street lighting easement; (iii) approximately 379 square feet (0.0087 acres) of the subject property for a permanent drainage easement; and (iv) approximately 5,138 square feet (0.1180 acres) of the subject property for a temporary construction easement (collectively, the "To Be Acquired Property"); and WHEREAS, the To Be Acquired Property is shown on that certain plat entitled "Plat Showing Right - of -Way Dedication and Vacation of Various Easements and Creation of Temporary Construction Easement, Permanent Drainage Easement and Permanent Street Lighting Easement on the Property of Fairfax Court Limited Partnership" dated May 25, 2022, prepared by Timmons Group of Ashburn, Virginia, and attached to this ordinance as Exhibit "A"; and WHEREAS, the City and Owner have been unable to reach agreement on the valuation for the To Be Acquired Property; and WHEREAS, due to the deadlines imposed in conjunction with the Project, the initiation of condemnation proceedings utilizing "quick -take" procedures is necessary, in the City's reasonable determination. NOW, THEREFORE, BE IT ORDAINED, by the City Council of the City of Fairfax, Virginia, that condemnation utilizing "quick -take" procedures of the To Be Acquired Property is necessary, for the reasons set forth in this ordinance, and staff is hereby authorized to initiate condemnation proceedings, including possession prior to the institution of the condemnation proceedings, in accordance with applicable law. This ordinance shall become effective as provided by law.
