2023-15ORDINANCE NO.2023-15 AN ORDINANCE AUTHORIZING "QUICK -TAKE" CONDEMNATION PROCEEDINGS FOR THE ACQUISITION OF CERTAIN PERMANENT AND TEMPORARY EASEMENTS ON PROPERTY OWNED BY FAIRFAX CHAIN BRIDGE HOTEL, L.L.C. AT 3521 CHAIN BRIDGE ROAD, AND HAVING TAX MAP NO.47-4-02-003-B. WHEREAS, the City has undertaken to install and construct certain trail improvements, and ancillary facilities, further identified as the "George T. Snyder Trail Project" (the "Project"); and WHEREAS, the City has determined that there is a public need to acquire the following permanent and temporary easements on portions of real property located within the municipal boundaries of the City, owned by Fairfax Chain Bridge Hotel, L.L.C. ("Owner"), located at 3521 Chain Bridge Road, and having Tax Map No. 47-4-02-003-B (the "Property"): (i) approximately 0.42 acres of the subject property for a permanent trail, drainage and maintenance easement; and (ii) approximately 0.057 acres of the subject property for a temporary construction easement (collectively, the "To Be Acquired Property"); and WHEREAS, the To Be Acquired Property is shown on the plat entitled "Plat Showing Trail, Drainage and Maintenance Easement and Temporary Construction Easement Through Lot 1 Subdivision of the M.V. Eaton Curran Property" dated December 13, 2021, prepared by Rice Associates of Manassas, Virginia, and attached to this ordinance as Exhibit "A"; and WHEREAS, the City and Owner have been unable to reach agreement on the valuation for the To Be Acquired Property; and WHEREAS, due to the deadlines imposed in conjunction with the Project, the initiation of condemnation proceedings utilizing "quick -take" procedures is necessary, in the City's reasonable determination. NOW, THEREFORE, BE IT ORDAINED, by the City Council of the City of Fairfax, Virginia, that condemnation utilizing "quick -take" procedures of the To Be Acquired Property is necessary, for the reasons set forth in this ordinance, and staff is hereby authorized to initiate condemnation proceedings, including possession prior to the institution of the condemnation proceedings, in accordance with applicable law. This ordinance shall become effective as provided by law.
