2023-11ORDINANCE NO.2023-11 AN ORDINANCE AUTHORIZING "QUICK -TAKE" CONDEMNATION PROCEEDINGS FOR THE ACQUISITION OF CERTAIN PUBLIC RIGHT-OF-WAY IN FEE SIMPLE, TOGETHER WITH GRADING AND TEMPORARY CONSTRUCTION EASEMENT(S), ON PROPERTY OWNED BY BRANCH AVENUE ASSOCIATES, LLC AT 10620 FAIRFAX BOULEVARD, AND HAVING TAX MAP NO.57-2-02-006. WHEREAS, the City has undertaken to install and construct certain roadway, intersection and ancillary improvements to Fairfax Boulevard in the vicinity of Warwick Avenue, further identified as the "U.S. 50 — Fairfax Boulevard Intersection Improvements Project" (the "Project"); and WHEREAS, the City has determined that there is a public need to acquire the following right-of-way (in fee simple) and certain temporary easement(s) on portions of real property located within the municipal boundaries of the City, owned by Branch Avenue Associates, LLC ("Owner"), located at 10620 Fairfax Boulevard, and having Tax Map No. 57-2-02-006 (the "Property"): (i) approximately 2,179.21 square feet of the subject property for public right-of-way (fee simple) and (ii) approximately 3,550.86 square feet of the subject property for grading and temporary construction easement(s) (collectively, the "To Be Acquired Property"); and WHEREAS, the To Be Acquired Property is shown on the "Right of Way Plans — Project 0050-151-225 (U.S. 50 — Fairfax Boulevard Intersection Improvements From 0.039 Miles West of Warwick Avenue to 0.047 Miles East of Farr Avenue" revised through February 7, 2023, and as the same may be further amended, prepared by Timmons Group of Richmond, Virginia, and attached to this ordinance as Exhibit "A" • and WHEREAS, the City and Owner have been unable to reach agreement on the valuation for the To Be Acquired Property; and WHEREAS, due to the deadlines imposed in conjunction with the Project, the initiation of condemnation proceedings utilizing "quick -take" procedures is necessary, in the City's reasonable determination. NOW, THEREFORE, BE IT ORDAINED, by the City Council of the City of Fairfax, Virginia, that condemnation utilizing "quick -take" procedures of the To Be Acquired Property is necessary, for the reasons set forth in this ordinance, and staff is hereby authorized to initiate condemnation proceedings, including possession prior to the institution of the condemnation proceedings, in accordance with applicable law. This ordinance shall become effective as provided by law.
