AN ORDINANCE APPROVING AND AUTHORIZING A BLANKET CONDITIONAL
LICENSE TO USE CERTAIN TO BE DESIGNATED SMALL PORTIONS OF CITY RIGHT-
OF-WAY NECESSARY TO IMPLEMENT THE CITY OF FAIRFAX SEASONAL OUTDOOR
DINING PILOT PROGRAM
THE CITY COUNCIL OF THE CITY OF FAIRFAX, VIRGINIA, HEREBY ORDAINS:
1. That a blanket, conditional license is hereby granted to approved applicants under the City of
Fairfax Seasonal Outdoor Dining Pilot Program (the "Program") to utilize, under the specific
terms and conditions of any approved application and permit granted under the Program, that
specific portion of City public right-of-way set forth and specifically delineated under such
approved application and permit. Approved applicants shall be required to execute such
documentation, and provide such necessary assurances to the City, in connection with such use as
may be required by City staff in consultation with the City Attorney.
2. That the license granted hereunder shall not grant to any individual or entity any ownership or
other property interest in and to the applicable right-of-way (or any other right-of-way of the
City) and that use of any approved right-of-way shall be limited to, and be in strict conformance
with, the terms of any approved application and permit granted under the Program. The license
granted hereunder shall terminate, automatically and without the need for any additional action by
the City Council, upon the expiration or sooner termination of an individual approved application
or permit, or termination of the Program.
This ordinance shall be effective as provided by law.
