2022-06ORDINANCE NO.2022-06 AN ORDINANCE AMENDING AND READOPTING CHAPTER 90, ARTICLE X, SECTION 90422 OF THE CODE OF THE CITY OF FAIRFAX, VIRGINIA, PERTAINING TO THE ADDITIONAL TAX IMPOSED UPON REAL PROPERTY AND IMPROVEMENTS LOCATED WITHIN THE OLD TOWN SERVICE DISTRICT BE IT ORDAINED, by the City Council of the City of Fairfax, Virginia, that Chapter 90, Article X, Section 90-422 of the Code of the City of Fairfax, Virginia, is hereby amended and readopted in its entirety as follows: Sec. 90422. - Additional tax imposed; maximum levy; applicability. To provide for additional and more complete governmental services within the Old Town Service District, effective on January 1, 2000, there is hereby levied a tax (in addition to other taxes levied upon owners of real property within the Old Town Service District) of SO.125 per S 100.00 of assessed valuation of real estate and improvements thereon located in the Old Town Service District. At no time during the pendency of the Old Town Service District shall the annual levy imposed by this section exceed the rate set forth in the preceding sentence. Effective on January 1, 202.022, the levy imposed in the immediately preceding sentence shall be reduced to $0.004 per S 100.00. Valuation and assessments of real property and improvements, timing with respect to valuation, assessment and payment, penalties and interest on delinquencies, assessment of new construction, and all other procedures for and details of administration and collection of the tax imposed by this article shall be the same as provided for by the city code and other applicable law for collection of real estate taxes generally. In addition to the foregoing, the levy imposed herein shall only be applicable to real property, and improvements thereon, located within the Old Town Service District that: (1) carries a non-residential zoning district designation as defined in the city zoning ordinance, but excluding any residential portions of such property that is not rental apartments; (ii) carries a multi -family residential zoning district designation (RMF), but only to the extent such residential multifamily use consists of rental apartments; or (iii) carries a planned development zoning district designation, but excluding any residential portions of such property that is not rental apartments. This ordinance shall be effective as of January 1, 2022, as provided by law. INTRODUCED: April 12, 2022 PUBLIC HEARING.
