AN ORDINANCE AMENDING ORDINANCE NO. 2020-18, REGARDING THE
PERMANENT VACATING, DISCONTINUING AND CLOSING OF A PORTION OF A
CITY PUBLIC RIGHT-OF-WAY (ORCHARD STREET).
WHEREAS, the City Council, on July 14, 2020, enacted Ordinance No. 2020-18,
regarding the permanent vacating, discontinuing and closing of a portion of the City's Orchard
Street public right-of-way, as more completely set forth therein; and
WHEREAS, the enacted ordinance required that various conditions set forth in the
ordinance be completed by the date that was one year following the date of enactment of the
ordinance; however, additional time is required to effectuate each of the enumerated conditions.
NOW, THEREFORE, BE IT ORDAINED by the City Council of the City of Fairfax,
Virginia, that the final operative paragraph of Ordinance No. 2020-18 be, and hereby is, amended
to read in its entirety as follows:
"BE IT FURTHER ORDAINED that if the above conditions, including but not
Iimited to the required corresponding dedication of right of way to effect the
realignment of Orchard Street and any associated easements have not been met by
December 3I, 2022, then such ordinance will be null and void with no further
action by City Council being necessary."
IT IS FURTHER ORDAINED that Ordinance No. 2020-18 shall be deemed to have been
continually operative and in effect without interruption since the date of its original enactment.
Except as expressly amended hereby, Ordinance No. 2020-18 is unmodified.
This Ordinance shall become effective as provided by law.
