AN ORDINANCE AUTHORIZING "QUICK -TAKE" CONDEMNATION PROCEEDINGS FOR THE
ACQUISITION OF A RIGHT OF WAY DEDICATION (PUBLIC STREET) AND VARIOUS
EASEMENTS ON THE PROPERTY OWNED BY D. MICHAEL PARRISH AND DEIDRE A.
PARRISH, HAVING TAX MAP NO. 57-2-02-132.
WHEREAS, the City has undertaken to install and construct certain sidewalk improvements along Chain Bridge
Road for public safety and convenience purposes; and
WHEREAS, the City has determined that there is a public need to acquire the following public street
dedication/right of way and various easements on a portion of real property located within the municipal
boundaries of the City, owned by D. Michael Parrish and Deidre A. Parrish (the "Owner"), located at 3735
Chain Bridge Road, and having Tax Map No. 57-2-02-132 (the "Property"): (i) approximately 2,164 square feet
of the subject property for public street'right of way purposes, (ii) approximately 404 square feet of the subject
property for permanent retaining wall maintenance/temporary construction easement(s); and (iii) approximately
486 square feet of the subject property for temporary construction easement(s) (collectively, the "To Be
Acquired Property"); and
WHEREAS, the To Be Acquired Property is shown on the Plat entitled "Plat Showing Right -of -Way Dedication
and Creation of Temporary Construction and Permanent Retaining Wall Maintenance Easements on the Property
of D. Michael & Deidre A. Parrish", prepared by Timmons Group of Ashburn, Virginia, dated June 30, 2020,
and attached to this ordinance as Exhibit "A"; and
WHEREAS, the City and the Owner have been unable to reach agreement on the valuation for the To Be
Acquired Property; and
WHEREAS, the initiation of condemnation proceedings utilizing "quick -take" procedures is necessary, in the
City's reasonable determination.
NOW, THEREFORE, BE IT ORDAINED, by the City Council of the City of Fairfax, Virginia, that
condemnation utilizing "quick -take" procedures of the To Be Acquired Property is necessary, for the reasons set
forth in this ordinance, and staff is hereby authorized to initiate condemnation proceedings, including possession
prior to the institution of the condemnation proceedings, in accordance with applicable law.
This Ordinance shall become effective as provided by law.
