CONSENT TO FIRST AMENDED AND RESTATED DECLARATION OF LOCAL
EMERGENCY
WHEREAS, the Governor of Virginia has declared a state of emergency and the
President of the United States has issued issued a Declaration of National Emergency, in each
case due to the current COVID-19 outbreak; and
WHEREAS, under the authority of Code of Virginia Sec. 44-146.21, the City Manager,
as Director of Emergency Management, declared a Local Emergency, effective on March 16,
2020, at 10:00 a.m. (the "Declaration"); and
WHEREAS, the Declaration expires by its terms on June 10, 2020, but the emergency
situation continues and the City Manager has executed a First Amended and Restated
Declaration of Local Emergency, dated June 8, 2020 (the "First Amended Declaration"), a
copy of which is attached to this resolution, to extend the Emergency Period (as defined therein)
until September 30, 2020 (unless sooner rescinded); and
WHEREAS, the City Council desires to consent to the First Amended Declaration.
NOW, THERFORE BE IT RESOLVED, by the City Council of the City of Fairfax,
Virginia, that it hereby consents to the First Amended Declaration. While the First Amended
Declaration remains in effect, the functions, obligations, rights, powers and duties of the
Director of Emergency Management shall be as prescribed by Title 44, Chapter 3.2 of the Code
of Virginia, the Code of the City of Fairfax, Virginia, the City of Fairfax Emergency Operations
Plan (EOP), and any other applicable laws, regulations and declarations pertaining to this
emergency, as the same currently exist or may be promulgated.
