Resolution Authorizing the City Manager to Execute the Agreement between the City
and the Department of Rail and Public Transportation (DRPT) governing the City's
required local contribution into Virginia's WMATA Capital Fund
WHEREAS, in 2018, the Virginia General Assembly approved dedicated funding for
WMATA, to be collected beginning in FY 2019; and
WHEREAS, the WMATA Capital Fund will be administered by DRPT; and
WHEREAS, a portion of the dedicated capital funding, $27.1 million, is to be collected
from "Local Funds" as authorized by Section 33.2-3404 of the Code of Virginia; and
WHEREAS, these local funds are to be paid by WMATA jurisdictions based on the current
WMATA capital subsidy allocation formula; and
WHEREAS, the WMATA Capital Fund is a new fund and execution of an agreement
between DRPT and jurisdictions is required before payment can begin; and
WHEREAS, the agreement outlines the requirements and responsibilities of DRPT and the
City regarding payment of the Local Funds;
WHEREAS, the City intends to use C&I funds for this payment upon confirmation that
WMATA's expenditure of the funds will comply with Va. Code Sec. 58.1-3221.3(B)(1),
which states acceptable uses of C&I funds. Otherwise the source will be NVTA 30% funding.
NOW THEREFORE, BE IT RESOLVED by the City Council of the City of Fairfax,
Virginia that the City Manager is hereby authorized to execute the Agreement between the
City and the Department of Rail and Public Transportation (DRPT) governing the City's
contribution to Virginia's WMATA Capital Fund.
