' RESOLUTION AUTHORIZING AND DIRECTING THE FILING OF A PETITION
FOR AN ORDER AND WRIT OF ELECTION TO FILL A VACANCY ON THE CITY
COUNCIL FOR THE CITY OF FAIRFAX
A t WHEREAS, at a special election conducted on February 7, 2017, David L. Meyer
was duly elected as Mayor of the City of Fairfax, Virginia (the "City"), to serve the remainder
of the unexpired term of former Mayor R. Scott Silverthorne; and
WHEREAS, Mayor Meyer resigned as a City Councilmember immediately before
assuming office as Mayor, on February 10, 2017; and
WHEREAS, the City Charter requires that any vacancy on the governing body be
filled in accordance with state law, and applicable state law requires that such vacancy be
filled by special election; and
WHEREAS, Va. Code Section 24.2-226 requires that the City Council, within fifteen
(15) days of the vacancy, petition the Circuit Court to issue a writ of election to fill the
vacancy pursuant to Article 5 of Chapter 6 of Title 24.2 of the Code of Virginia.
NOW THEREFORE BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY
OF FAIRFAX THAT:
1. The City Attorney is hereby authorized and directed to prepare and to file a
petition, in the form required by law, with the Circuit Court, requesting that the
Circuit Court issue an order and writ of election for the holding of a special
election on Tuesday, September 12, 2017, to fill the vacancy in the office of
Mayor resulting from the resignation of Councilmember David L. Meyer.
2. This Resolution shall take effect immediately upon its adoption.
