RESOLUTION AUTHORIZING AND DIRECTING THE FILING OF A PETITION
FOR AN ORDER AND WRIT OF ELECTION TO FILL A VACANCY IN THE
OFFICE OF MAYOR FOR THE CITY OF FAIRFAX
WHEREAS, on August 8, 2016, Mayor R. Scott Silverthorne ("Mayor Silverthorne")
submitted his resignation from the office of Mayor, effective August 11, 2016; and
WHEREAS, Mayor Silverthorne's term extends through June 30, 2018, and
applicable state law provides that any vacancy in the office of Mayor, as with any vacancy in
the office of City Council member, be filled by special election; and
WHEREAS, Va. Code Section 24.2-226 requires that the City Council, within fifteen
(15) days of the vacancy, petition the Circuit Court to issue a writ of election to fill the
vacancy pursuant to Article 5 of Chapter 6 of Title 24.2 of the Code of Virginia.
NOW THEREFORE BE IT RESOLVED BY THE CITY COUNCIL OF THE
CITY OF FAIRFAX THAT:
1. The City Attorney is hereby authorized and directed to prepare and to file a
petition, in the form required by law, with the Circuit Court, requesting that the
Circuit Court issue an order and writ of election for the holding of a special
election on Tuesday, February 7, 2017, to fill the vacancy in the office of Mayor
resulting from the resignation.of Mayor Silverthorne.
2. This Resolution shall take effect immediately upon its adoption.
Adopted this 16th day of August, 2016.
