RESOLUTION TO APPROVE THE REQUEST OF LUBY'S FUDDRUCKERS
RESTAURANTS, LLC, BY DAVID E. HAWKINS, AGENT, FOR SPECIAL
EXCEPTIONS TO CITY CODE TO:
1. Reduce the minimum yard requirements as pursuant Section 110-783(6);
on the premises known as 3575 Chain Bridge Road, and more particularly described as tax
map parcels 57-2-02-24a and 57-2-02-24b.
WHEREAS, Luby's Fuddruckers Restaurants, LLC, by David E. Hawkins, agent, has
submitted Application No. 5E-15110085 requesting Special Exceptions to the City Code as
listed above; and
WHEREAS, City Council has carefully considered the application, the
recommendation from Staff, and testimony received at the public hearing; and
WHEREAS, City Council has determined that the proposed Special Exceptions are
appropriate because the proposal meets the requisites established by City of Fairfax Code
Sections 110-783 (6) for the following reasons:
1) The requests have been designed in a manner which will complement the
character of the surrounding neighborhood with respect to building size, scale,
placement, design and use of materials;
2) The proposed design, material, texture, color, lighting, landscaping, dimension,
line, mass, roof line and height of the proposed structure or improvements will
harmonize with the surrounding buildings and area
3) The orientation and location of the proposed structure or improvement, and its
relationship to open spaces and topography, will be harmonious with the
surrounding buildings and area.
4) The design of the proposed structures and site would provide for the safe and
efficient movement of pedestrian and vehicular traffic.
5) The requests will not result in increased traffic congestion or otherwise
negatively impact existing traffic flow or pedestrian and vehicular safety.
6) The requests will not be contrary to the objectives specified in the
comprehensive plan.
7) The relief is necessary to permit reasonable use of the subject property.
8) The requests will not adversely impact adjacent property or the surrounding
area.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of
Fairfax on this 23RD day of February, 2016, that Application No. 5E-15110085 be and hereby
is APPROVED, as requested.
