AN ORDINANCE AMENDING CHAPTER 98, ARTICLE I, OF THE CODE OF THE
CITY OF FAIRFAX, VIRGINIA, PERTAINING TO A BICYCLE HELMET LAW
FOR CHILDREN.
BE IT ORDAINED, by the City Council of the City of Fairfax, Virginia, that Chapter 98,
Article I, of the Code of the City of Fairfax, Virginia, is hereby amended to add a new Section
98-23, to read in its entirety as follows:
"Sec. 98-23. — Use of a protective helmet while operating a bicycle.
Any person fourteen years of age and younger shall wear a protective helmet
that, at a minimum, meets the Consumer Product Safety Commission standard
while riding or being carried on a bicycle or an electric power -assisted bicycle
on any highway (as defined in Section 46.2-100 of the Code of Virginia),
sidewalk, or public bicycle path. Violation of this section shall be punishable
by a fine of twenty-five dollars. However, such fine shall be suspended for
first-time violators and for violators who, subsequent to the violation but prior
to imposition of the fine, purchase, or otherwise acquire, helmets of the type
required by this section."
This ordinance shall become effective as provided by law.
