R-15-46RESOLUTION NO. R-15-46 Resolution to approve the request of Kenneth K. Lee, Manager, representing Kwang and Lee Property, LLC, applicant, for a special exception pursuant to section 110-845(6) of the City Code to allow a fence within the front building restriction area of a lot in the I-2 Industrial District on the premises known as 3159 Campbell Drive, and more particularly described as Tax Map Parcel 48-3-09-025A. WHEREAS, Kwang and Lee Property, LLC, has submitted Application No. SE - 14120158 requesting a Special Exception to the City Code Section listed below: Section 110-845(2) c Within the building restriction areas in commercial and industrial districts or within 25 feet from the right-of-way line of properties within such districts, whichever is less, no fence, wall, structure, automobile parking area, unloading area or other impervious area except permitted signs, sidewalks, driveways for ingress and egress shall be permitted nor shall any merchandise be displayed. Such building restriction areas shall be landscaped pursuant to a plan approved by the planning director. WHEREAS, City Council has carefully considered the application, the recommendation of the staff and testimony received at the public hearing; and WHEREAS, City Council has determined that the proposed Special Exception request is appropriate because the proposal meets the requisites established by the City of Fairfax Code Sections 110-846 (6) and 110-366 (3) for the following reasons: 1. The request is generally consistent with the recommendations of the Comprehensive Plan, 2. The site design is appropriate, 3. Approval of the request will not adversely impact adjacent properties, and 4. The request will not be contrary to the objectives specified in the comprehensive plan. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Fairfax on the 27 day of October, 2015 that Application No. SE -14120158 be and hereby is APPROVED with the following conditions: 1. Construction of the fence shall be in substantial conformance with the attached Special Exception Plat (Exhibit D) received October 1, 2015. 2. Prior to installation of the fence, the applicant shall replace all dead trees along the front property line and shall install evergreen shrubs and an evergreen tree along the rear property and dumpster area in accordance with the Revision —Plantings plan dated September 30, 2015. 3. No use or activity shall be permitted in approved landscape areas (such as vehicle access path into the building on the Roanoke property and/or storage of materials/vehicles).
