R-15-36RESOLUTION NO. R-15-36 Resolution to approve the request of IDI-RJL development, LLC, by David Houston, Attorney -in -Fact for special exceptions to City Code to: 1. Allow proposed structures to exceed the maximum height of five stories and 60 feet as required by section 110-704(4); 2. Allow gross density to exceed 4 dwelling units per acre and allow less than 1,000 square feet of office space per dwelling unit as required by section 110-704(5); 3. Allow residential parking to be located on a separate parcel from the principal use per section 110-152 (c); 4. Allow parking to be located adjacent to a property line without a landscape buffer as required in section 110-259 (a)(1 )(b). on the premises known as 9431 to 9495 Silver King Court, inclusive, and more particularly described as tax map parcels 58-2-10-01-001 through 58-2-10-01-007, 58-2-10-001-13, 58-2- 10-001-C and 58-2-10-02-001-A. WHEREAS, IDI-RJL Development, LLC, by David Houston, Attorney -in -Fact, has submitted Application No. SE -15010011 requesting Special Exceptions to the City Code as listed above; and WHEREAS, City Council has carefully considered the application, the recommendation from Staff, the recommendation from the Planning Commission, and testimony received at the public hearing; and WHEREAS, City Council has determined that the proposed Special Exceptions are appropriate because the proposal meets the requisites established by City of Fairfax Code Sections 110-704 (7) and 110-263 for the following reasons: 1) The requests have been designed in a manner which will complement the character of the surrounding neighborhood with respect to building size, scale, placement, design and use of materials; 2) The proposed design, material, texture, color, lighting, landscaping, dimension, line, mass, roof line and height of the proposed structure or improvements will harmonize with the surrounding buildings and area 3) The orientation and location of the proposed structure or improvement, and its relationship to open spaces and topography, will be harmonious with the surrounding buildings and area. 4) The design of the proposed structures and site would PROVIDE for the safe and efficient movement of pedestrian and vehicular traffic. 5) The requests will not result in increased traffic congestion or otherwise negatively impact existing traffic flow or pedestrian and vehicular safety. 6) The requests will not be contrary to the objectives specified in the comprehensive plan. 7) The relief is necessary to permit reasonable use of the subject property. 8) The requests will not adversely impact adjacent property or the surrounding area. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Fairfax on this 8TH day of September, 2015, that Application No. SE -15010011 be and hereby is APPROVED, as requested, with the proffered conditions revised through September 1, 2015 and with the following conditions. 1. Development of the subject site shall be in substantial conformance with the attached plans dated December 23, 2014 and revised on September 1, 2015, and further revised on September 8, 2015, as may be modified by the City Council. 2. At initial construction, the development shall include no more than sixteen (16) three- bedroom units and no fewer than (16) one -bedroom units. 3.
