R-15-01RESOLUTION NO. R-15-01 A RESOLUTION ESTABLISHING A TOWING ADVISORY BOARD PURSUANT TO VIRGINIA CODE SECTION 46.2-1217 FOR THE PURPOSE OF ADVISING THE CITY COUNCIL WITH RESPECT TO THE TERMS OF A CONTRACT FOR POLICE -REQUESTED TOWING SERVICES. WHEREAS, Virginia Code Section 46.2-1217 permits governing bodies of localities o regulate by ordinance services rendered by businesses engaged in the towing or storage of attended, abandoned, or immobile vehicles pursuant to police towing requests; and WHEREAS, the City of Fairfax has adopted such an ordinance in Section 98-156 et se . of the City Code; and WHEREAS, Virginia Code Section 46.2-1217 allows the governing bodies of localities to contract for services rendered pursuant to a police towing request with one or more businesses engaged in the towing or storage of unattended, abandoned, or immobile vehicles; and WHEREAS, prior to entering into such a contract, Virginia Code Section 46.2-1217 [uires the local governing body to appoint an advisory board consisting of representatives local law-enforcement agencies, towing and recovery operators, and the general public, to vise the governing body with regard to the appropriate terms of the contract; and WHEREAS, the City intends to contract for police -requested towing services pursuant to Virginia Code Section 46.2-1217, and in order to comply with the requirements of the statute, hereby appoints a towing advisory board. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Fairfax that a towing advisory board is hereby established in accordance with Virginia Code Section 46.2-1217 for the purpose of advising the City Council with respect to the terms of a contract for police -requested towing services. BE IT FURTHER RESOLVED by the City Council of the City of Fairfax that the following persons are hereby appointed to the towing advisory board, with terms expiring on I December 31, 2016: Captain Jeffrey E. Hunt, Commander, Support Operations Division, City of Fairfax Police Department Lieutenant Matthew D. Duckett, Supervisor, Traffic Section, City of Fairfax Police Department Kevin Frank, a representative, Central Fairfax Chamber of Commerce John Reynolds, a representative from the towing industry Joseph Beck, West End Citizen of the City of Fairfax Beverly Myers, East End Citizen of the City of Fairfax ADOPTED this 13th day of January, 2014.
