R-14-72 RESOLUTION TO APPROVE THE REQUEST BY THE LAMB CENTER,FOR SPECIAL EXCEPTIONS PURSUANT TO CITY CODE SECTION 110-263,TO REDUCE THE 25-FOOT SCREENING AND PERIMETER LANDSCAPING REQUIREMENTS; PURSUANT TO CITY CODE SECTION 110-845(6),TO REDUCE THE 25-FOOT FRONT YARD SETBACK; PURSUANT TO CITY CODE SECTION 110-158,TO MODIFY THE REQUIREMENT TO PROVIDE SEPARATION FROM A STRUCTURE; AND PURSUANT TO CITY CODE SECTION 110-369,TO ALLOW UTILITIES IN THE ADJOINING RIGHT-OF-WAY TO REMAIN ABOVE GROUND ON THE PREMISES DE�RIBED AS TAX MAP PARCELS 8�3(9))8 & 29.0 PARTICULARLY WHEREAS, The Lamb Center, has submitted Application No. SE-14110029 requesting Special Exceptions to Sections 110-258 (a), 110-259 (a)(1) a & b, 110-845(2)a, 110-153(3) and 110-105(k) to reduce the 25-foot screening requirement; to reduce the perimeter landscaping requirement; to reduce the 25-foot front yard setback requirement; to allow a drive aisle without a separation from a building; and to allow utilities in the adjoining right-of-way to remain above ground; and WHEREAS, City Council has carefully considered the application, the recommendation from Staff, and testimony received at the public hearing; and WHEREAS, City Council has determined that the proposed Special Exception is appropriate because the proposal, as modified by the conditions of approval, meets the requisites established by City of Fairfax Code Sections 110-158,110-263,110-366 and 110- 369 for the following reasons: 1) The request is consistent with the Comprehensive Plan and other adopted city goals and policies; 2) The request is necessary to permit reasonable use of the subject property; 3) The request will not adversely impact adjacent property or the surrounding area. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Fairfax on this 18th day of November, 2014, that Application No. SE-14110029 be and hereby is APPROVED, with the following conditions: 1. Development of the site shall be in substantial conformance with the attached Special Use Permit and Special Exception Plat dated May 15, 2014 and revised through October 27, 2014 and the Architectural Plan dated June 5, 2014 and revised through October 28, 2014. 2. The operation of the facility shall be in substantial conformance with the attached Communications/Community Outreach plan, Loitering Plan, Litter Control Plan, Business Operation Program and Monitoring and Maintenance Plan prepared on August 29, 2014. 3. During the first year of operation, the applicant shall meet on a quarterly basis with City staff with a report to the City Council to review calls for service and the loitering, monitoring, and maintenance plans. 4. The hours of operation for The Lamb Center shall be the following: • Monday through Friday- 8:00 a.m. -3:00 p.m. • Saturday- 8:00 a.m.-12:30 p.m. and during the months of April through October, The Lamb Center shall be open Friday evenings from 6:00 p.m. through 8:30 p.m. Adopted this 18th day of November, 2014.
