R-14-71 RESOLUTION NO. R-14-71 RESOLUTION TO APPROVE THE REQUEST OF THE REBKEE COMPANY, BY SARAH HALL,AGENT, FOR A SPECIAL EXCEPTION PURSUANT TO SECTION 110-263 TO REDUCE THE REQUIRED PARKING LANDSCAPE STRIP AND TO ALLOW A LAND DISTURBANCE OF GREATER THAN 2,500 SQUARE FEET IN A RESOURCE PROTECTION AREA PURSUANT TO CITY CODE SECTION 110-89 ON THE PREMISES KNOWN AS 10100 FAIRFAX BOULEVARD, AND MORE PARTICULARLY DESCRIBED AS TAX MAP PARCELS 47-4-23-000-C. WHEREAS, THE REBKEE COMPANY, has submitted Application No. SE- 14060126 requesting two Special Exceptions to the City Code Sections listed below: Section 110-84(b)(4) Notwithstanding any other provisions of this division, or any exceptions or exemptions thereto, any land disturbing activity exceeding 2,500 square feet, including construction of all single-family houses, septic tanks, and drainfields, shall comply with the requirements of the chapter 110, division 12, Erosion and sediment control; and Section 110-259(a) (1) Where parking area is adjacent to right-of-way. Each off-street parking area which is adjacent to a public right-of-way shall be separated from such right-of-way by a landscaped strip of not less than the width of the required building restriction area for the zoning district within which such parking area is located. Such strip shall contain an earthen berm, compact evergreen hedge or an equal or better alternative approved by the director. Landscaping shall be no less than 30 inches in height at the time of installation and mulched to a depth of at least four inches. In addition, such strip shall contain at least one deciduous tree not less than 31/4 inches in caliper measured six inches above the ground level for every 500 square feet of required landscaped strip; WHEREAS, City Council has carefully considered the application, the recommendation of the staff and testimony received at the public hearing; and WHEREAS, City Council has determined that the proposed Special Exception request is appropriate because the proposal meets the requisites established by the City of Fairfax Code Sections 110-366 and 110-263 for the following reasons: 1. The request is generally consistent with the recommendations of the Comprehensive Plan, 2. Vehicular and pedestrian traffic will not be compromised, 3. The site design is appropriate, and 4. Approval of the request will not adversely impact adjacent properties. NOW,THEREFORE, BE IT RESOLVED by the City Council of the City of Fairfax on the 18 day of November, 2014 that Application No. SE-14060126 be and hereby is APPROVED with the following conditions: 1. Final plans shall be in substantial conformance with the Special Use Permit Plat dated June 18, 2014, revised October 3, 2014 and stamped by the engineer on October 14, 2014. EIFS, and 2. All building facades shall incorporate a mixture of brick, precast concrete, other materials as shown on the attached perspective renderings, with final approval of materials, colors, banding and landscape subject to review and approval by the Board of Architectural Review. 3. All overhead utilities located on-site, as well as those which cross Plantation Parkway shall be undergrounded. 4. The applicant shall not prohibit the general public from parking on the property in order to use the US Postal Service mail box located in the adjacent right-of-way for as long as that mail box is at that location. 5. Within 30 days after issuance of a non-residential use permit, the applicant shall provide a contribution to the City to be determined by the Department of Parks and Recreation, not to exceed $7,000, to be used for the design, construction and installation of signage for the Snyder Trail. 6. The applicant shall provide an easement for staging and access for the construction of the proposed Snyder Trail with an approximate area as shown in Exhibit 1. Duration of the easement shall be determined in consultation with the City, but shall not commence prior to February 1, 2015, or extend beyond June 1, 2015. 7. Tenant signage shall be limited to one ground mounted sign and two building mounted signs, exclusive of directional signage. Building mounted signs shall be confined to the south and east faces of the building and individual sign dimensions shall not exceed dimensions as shown in the approved Special Use Permit Plat.
